1. Acceptance of Terms

By requesting or accepting plumbing services from O’Mary Brothers Plumbing Inc. ("the Company," "we," "us," or "our"), you ("the Customer," "you," or "your") agree to be bound by these Terms of Service. These terms apply to all services provided, whether scheduled via phone at (502) 425-4137, our website, or in person.

2. Scope of Work & Estimates

Estimates: Any price provided over the phone or via email is a non-binding estimate based on the information provided by the Customer.

On-Site Inspection: Final pricing is determined only after an on-site inspection by a licensed plumber. We reserve the right to adjust the quote if unforeseen issues (such as hidden pipe corrosion or code violations) are discovered during the work.

Customer Approval: No work will begin until the Customer has approved the final estimate.

3. Payment Terms

Due Date: Payment is due in full upon completion of the service unless otherwise agreed upon in writing.

Methods: We accept cash, checks, and major credit cards.

Late Fees: Past due accounts may be subject to a late fee of 1.5% per month or the maximum allowed by Kentucky law. The Customer is responsible for all costs of collection, including reasonable attorney fees.

4. Access to Property

The Customer must provide clear access to the work area (e.g., clearing out cabinets under sinks, ensuring crawl spaces are accessible). If our plumbers cannot access the area at the scheduled time, a "Service Call Fee" may still apply.

5. Limited Warranty

Workmanship: We warrant our labor for a period of 90 days from the date of service. This warranty covers defects in our workmanship only.

Materials: Parts and fixtures are covered by the manufacturer’s warranty only. We do not warrant the performance of parts we did not manufacture.

Exclusions: This warranty is void if the plumbing system is tampered with by an unauthorized party or if the issue is caused by "acts of God" (e.g., frozen pipes due to extreme weather).

6. Limitation of Liability

To the maximum extent permitted by Kentucky law, O’Mary Brothers Plumbing Inc. shall not be liable for:

Pre-existing conditions or damages caused by aging or faulty plumbing systems.

Indirect, incidental, or consequential damages (such as water damage to floors or drywall) resulting from a leak, unless caused by our gross negligence.

Delays caused by parts availability or weather conditions.

7. Cancellation Policy

Customers must provide at least 24 hours' notice to cancel or reschedule an appointment. Cancellations made with less than 24 hours' notice may be subject to a cancellation fee.

8. Dispute Resolution & Governing Law

These Terms shall be governed by the laws of the Commonwealth of Kentucky. Any disputes arising from our services shall be resolved in the courts of Jefferson County, Kentucky.
